The work covers the full life of a dispute, from early advice and pre-action correspondence through to litigation, alternative dispute resolution and enforcement. Phoebe supports partners and associates on the team.
Phoebe works on a wide range of commercial and residential property disputes. These include lease renewals under the Landlord and Tenant Act 1954, dilapidations claims, forfeiture and the recovery of rent arrears, service charge disputes, breaches of covenant, boundary and rights of way issues, and possession proceedings, including claims against trespassers.
A large part of her role is legal research and analysis. She reviews leases, title documents and correspondence to identify the key issues. She researches points of property law and procedure and prepares research notes and advice for the wider team. She also drafts a variety of documents, such as letters of claim and responses, statutory notices, witness statements, applications and court forms. She helps prepare instructions to counsel and to experts, including surveyors and valuers.
On matters that reach litigation, she helps manage the procedural side of the case under the Civil Procedure Rules. This includes:
- preparing and managing disclosure
- putting together trial and hearing bundles
- tracking court deadlines
- liaising with the court, counsel, experts and the other side
Where possible, she attends hearings, mediations and client meetings. She takes notes and helps with preparation and follow-up actions.
Alongside her fee-earning work, she supports the team's business development and knowledge activities. For example, she researches legal updates, contribute to client briefings and help prepare training materials.
This seat gives Phoebe broad experience of contentious real estate work. It is helping her build skills in drafting, legal analysis, case management and client care, and it is deepening her understanding of how property disputes are resolved in practice.
